These Terms and Conditions (“Terms”) govern your use of our website and the services provided by Timeless Tributes AI Pty Ltd. By engaging our services, you agree to be bound by these Terms.
1. Introduction & Acceptance
By placing an order with Timeless Tributes (“we,” “us,” or “our”), you (“Client”) acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Ethical AI Policy.
We recommend that you print or save a copy of these Terms for your records.
2. Our Services
Timeless Tributes uses advanced artificial intelligence combined with human artistry to restore, upscale, colorize, and subtly animate old photographs. These images are then crafted into cinematic video tributes with AI-generated music for funerals, birthdays, weddings, anniversaries, and other commemorative occasions.
We serve both individual clients and business partners (such as funeral directors) through white-label partnerships.
3. Quotes, Payments & Fees
3.1 Quotes
All quotes provided by Timeless Tributes are valid for a period of [30 days] from the date of issue, unless otherwise stated.
3.2 Deposit
To commence work on your tribute, a 50% non-refundable deposit is required. By proceeding with your order, you acknowledge and agree that:
“I understand a 50% deposit is required to begin work on my tribute.”
This deposit secures your place in our production schedule and covers initial AI processing and creative consultation time.
3.3 Rush Fees
If you require expedited delivery, a rush fee may apply. Rush fees will be quoted based on current production schedules and must be agreed upon in writing before work commences.
3.4 Additional Revisions and Add-Ons
-Your project includes [2] rounds of revisions as standard.
-Additional revision rounds beyond this will incur a fee of $[Amount] per round.
-Add-ons such as extra photos, extended video length, or premium music licenses are available at an additional cost. These will be quoted prior to commencement.
3.5 Final Payment
Final payment of the remaining balance is required prior to the release of the final, high-resolution premiere video, unless you are a Trusted Business Partner with an established credit account.
“I understand that final payment must be made before high-resolution files are released.”
3.6 Payment Methods
We accept payment via [Stripe, credit card, direct deposit, PayPal, etc.]. All prices are in Australian Dollars (AUD) and include GST where applicable.
4. Project Timeline & Client Responsibilities
4.1 Client Cooperation
The success and timely delivery of your project depend on your prompt cooperation. You acknowledge that:
“It is my responsibility to respond to notifications from Timeless Tributes within a reasonable time to ensure timely delivery of my tribute.”
Failure to respond to requests for feedback or approval within [7 days] may result in project delays, for which Timeless Tributes is not responsible.
4.2 Preview Watermarks
All previews and drafts provided for your review will contain a visible watermark.
“I understand that all previews are watermarked until final payment is received.”
4.3 Final Approval
Once you have reviewed the final draft, you will be asked to click an ‘APPROVE’ button within your client portal. By clicking ‘APPROVE’, you acknowledge and agree that:
“Clicking ‘APPROVE’ will trigger the final invoice for the remaining balance of $[Amount], and that payment is required before high-resolution files are released.”
“I acknowledge that major changes cannot be made after final approval without incurring additional editing fees.”
“I confirm that I have the authority to approve this tribute on behalf of the family or estate.”
5. Delivery, Storage & Backup
5.1 Digital Delivery
Final files will be delivered digitally via your secure client portal. You will receive a download link via email.
“I understand the final files will be delivered digitally via the secure client portal and are my responsibility to download and back up.”
5.2 Download Period and Legacy Vault
Files are stored in your portal for 12 months from the date of final delivery.
“I acknowledge that it is my responsibility to download all files from the portal and the Legacy Vault before the links expire and before they are removed from the portal after 12 months.”
5.3 Backup Responsibility
Timeless Tributes strongly recommends maintaining multiple copies of your final tribute.
“I acknowledge that it is my responsibility to safely store downloads, create backups, and maintain at least one alternative method of playback (such as a USB drive, cloud storage or a collaborator).”
We are not responsible for the loss of files due to client error, hardware failure, or failure to download within the specified timeframe.
6. Playback Capabilities & Venue Testing (critical)
Playback issues at venues are one of the most common points of failure for video tributes. To ensure your tribute plays without issue, you agree to the following terms:
6.1 Pre-Event Testing Obligation
“I confirm that the tribute file WILL BE TESTED at the venue prior to the service.”
“I understand that if venue specifications were not provided to Timeless Tributes, testing is mandatory to avoid technical issues.”
6.2 Testing Window
You or the venue technician must test playback capabilities at least 24 hours prior to the premiere using a sample video provided by Timeless Tributes.
Furthermore, you agree to:
“Test the final premiere video at the venue as early as practical to allow Timeless Tributes to troubleshoot technical issues in time.”
6.3 Limitation of Liability for Playback
“I acknowledge that Timeless Tributes is not liable for playback issues caused by untested venue equipment, incompatible file formats, or internet failure at the venue.”
We are happy to provide technical support and guidance, but we cannot control third-party hardware, software, or internet connectivity at your chosen venue.

7. Intellectual Property & Usage Rights
7.1 Your Ownership
You retain all ownership rights to the original photographs you submit. Timeless Tributes claims no ownership over your personal images.
7.2 License to Use
By submitting content to us, you grant Timeless Tributes a non-exclusive license to reproduce, edit, and adapt the material solely for the purpose of creating your tribute.
7.3 Music Licensing and Synchronization Rights (CRITICAL)
Timeless Tributes specializes in creating high-quality cinematic tributes; however, we are not a music licensing agency.
Due to the extreme costs, administrative burden, and delays associated with obtaining commercial synchronization (“sync”) licenses, Timeless Tributes cannot synchronize your tribute with most popular, copyrighted, or licensed songs, unless you are able to obtain the necessary licenses independently or qualify for a specific exemption.
Client Responsibility and Acknowledgment:
By engaging our services, you acknowledge and agree that:
“I understand that Timeless Tributes cannot synchronize my tribute with popular or licensed music unless I provide evidence of the necessary synchronization license or qualify for a statutory exemption (such as those offered by OneMusic Australia for certain funeral directors, businesses, or venues).”
“I acknowledge that I will not breach Australian copyright laws by editing the work of Timeless Tributes to add unlicensed music after delivery, nor will I publicly share, broadcast, or distribute any content that incorporates unlicensed music.”
“I agree to indemnify and hold harmless Timeless Tributes AI Pty Ltd against any claims, damages, or losses arising from my unauthorized use of copyrighted music in connection with the tribute.”
7.4 Sample Usage Consent (*Optional)
We take great pride in our work and occasionally use samples to showcase our craftsmanship. You have the option to consent to the following:
*”I consent to Timeless Tributes using an anonymized 1-minute sample of my tribute for portfolio, marketing, or educational purposes.”*
You are under no obligation to grant this consent, and your refusal will not affect the quality of service you receive.
7.5 AI-Generated Content
The music and animations generated by AI for your tribute are licensed to you for personal, non-commercial use. You may not resell or commercially exploit the AI-generated components of your tribute without our written consent.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Timeless Tributes AI Pty Ltd shall not be liable for:
-Any indirect, incidental, or consequential damages arising from the use or inability to use our services.
-Playback failures at venues due to third-party equipment or connectivity.
-Emotional distress arising from the content of the tribute, as the creative direction and final approval rest solely with the Client.
Our total liability to you shall not exceed the total amount paid by you for the specific project giving rise to the claim.
9. Cancellation & Refunds
9.1 Client-Initiated Cancellation
If you wish to cancel your project after work has begun, the 50% deposit is non-refundable to cover time and resources already committed. If cancellation occurs after the final approval stage, the full balance remains due.
9.2 Quality Guarantee
If you are unsatisfied with the initial draft, we will work with you through the included revision rounds to achieve a result you are happy with. Refunds are not issued due to subjective preferences after work has commenced, but we are committed to ensuring you love your final tribute.
10. Governing Law
These Terms shall be governed by and construed in accordance with the Australian law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
11. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services after any changes indicates your acceptance of the revised Terms.

Final Client Acknowledgment
